01Acceptance of terms
These Terms & Conditions ("Terms") govern your use of the website and services of Cypress Roofing & Exteriors ("Cypress," "we," "us," or "our"). By accessing our website, requesting an inspection or estimate, or engaging us for work, you agree to these Terms. If you do not agree, please do not use the website or our services.
02Our services
Cypress provides residential and commercial roofing and exterior services, including roof replacement and installation, roof repair, storm damage repair and restoration, siding, gutters, windows, fencing, exterior renovations, roof coatings and maintenance, and related services across North and Central Alabama. Service descriptions on our website are general; the specific scope of any project is defined in a written agreement signed by you and an authorized Cypress representative.
03Inspections, estimates & quotes
We offer free inspections and written estimates. An inspection, estimate, or quote is informational and does not create a binding contract. Work is authorized only when you and Cypress sign a written project agreement or work order. Estimates are based on conditions visible at the time of inspection; if hidden damage, code requirements, or unforeseen conditions are discovered, we will notify you and provide a change order for your approval before performing additional work.
04Scheduling & site access
Project timelines are estimates and may be affected by weather, material availability, permitting, insurance approvals, and other factors outside our control. You agree to provide safe and reasonable access to the property and work areas, and to identify any known hazards, underground utilities, or sensitive features before work begins.
05Pricing & payment
Pricing, deposit requirements, payment schedule, and accepted payment methods are set out in your signed project agreement. Past-due balances may accrue interest and collection costs as permitted by Alabama law. Financing, where offered, is provided by independent third-party lenders subject to their own terms and approval; Cypress is not the lender and does not guarantee financing approval.
06Workmanship warranty
Qualifying projects are backed by a Cypress workmanship warranty of up to ten (10) years, as specified in your project agreement. The warranty covers workmanship only and is separate from manufacturer warranties on materials, which are provided by the manufacturer under their own terms. Warranty coverage may be voided by unauthorized repairs or alterations, failure to perform required maintenance, storm or casualty damage, or nonpayment. Full warranty terms, exclusions, and transfer conditions are provided in writing with your project.
07Insurance claim assistance
We can guide you through the insurance claim process for storm and other covered damage and work with your carrier and adjuster. Please understand:
- Cypress is a roofing and exterior contractor, not a public adjuster, law firm, or insurance company, and we do not provide insurance or legal advice or adjust claims on your behalf.
- We do not guarantee that your insurer will approve, or pay any particular amount on, a claim. Coverage decisions are made solely by your insurance carrier.
- You are responsible for your insurance deductible. Consistent with Alabama law, we will not pay, waive, rebate, or absorb any portion of your deductible or offer anything of value to induce a claim.
- You remain responsible for the accuracy of information you submit to your insurer.
08Communications consent
By providing your contact information, you agree that Cypress and its authorized representatives may contact you by phone, text message, and email about your inquiry, your project, and — where permitted and subject to your preferences — promotions and updates. Marketing consent is not a condition of purchase. You can opt out of marketing emails using the unsubscribe link in any message and stop text messages by replying STOP. How we collect and use your information is described in our Privacy Policy.
09Website & intellectual property
All content on our website — including text, graphics, logos, photographs, and the Cypress Roofing & Exteriors name and marks — is owned by or licensed to Cypress and protected by applicable law. You may view and use the website for your personal, non-commercial purpose of learning about and engaging our services. You may not copy, reproduce, or distribute our content without our written permission.
10Disclaimers
OUR WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THIS SECTION DOES NOT LIMIT THE WORKMANSHIP WARRANTY EXPRESSLY PROVIDED IN YOUR SIGNED PROJECT AGREEMENT.
11Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CYPRESS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER ALABAMA LAW, AND LIABILITY ARISING FROM ACTUAL PROJECT WORK IS GOVERNED BY YOUR SIGNED PROJECT AGREEMENT.
12Indemnification
You agree to indemnify and hold harmless Cypress from claims, damages, and expenses arising out of your misuse of the website or your violation of these Terms or applicable law.
13Governing law & disputes
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. You agree that any dispute relating to the website or these Terms will be brought in the state or federal courts located in Alabama, and you consent to their jurisdiction. Disputes arising from a specific project are governed by the dispute-resolution provisions of your signed project agreement.
14General terms
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy and any signed project agreement, are the entire agreement between you and Cypress regarding the website and our services. We may update these Terms at any time by posting a revised version with a new effective date; your continued use means you accept the changes.
